DIC Benefits: What Surviving Families Are Owed

If your spouse or parent died from a service-connected condition — or was totally disabled for 10+ years before death — the VA owes you monthly compensation. Most families never collect it.

What Is DIC?

Dependency and Indemnity Compensation (DIC) is a tax-free monthly benefit paid to eligible survivors of veterans whose death was related to military service. As of 2024, the base rate for a surviving spouse is $1,562.74 per month, with additional allowances for children, dependent parents, and Aid and Attendance needs.

Who Qualifies?

You may qualify for DIC if you are the surviving spouse, child, or parent of a veteran who:

  • Died from a service-connected condition — the same conditions covered by VA disability (cancer, PTSD, heart disease, respiratory illness, etc.)
  • Was rated totally disabled (100% P&T) for at least 10 years before death, even if the death was not from the service-connected condition
  • Was rated 100% P&T for at least 5 years from the date of discharge and died after those 5 years
  • Was a POW rated totally disabled for at least 1 year before death

You do not need to have been married to the veteran at the time of service — only at the time of death (and for at least 1 year, or have a child together, or the veteran died on active duty).

How to Apply

File VA Form 21P-534EZ (Application for DIC, Death Pension, and/or Accrued Benefits). Key evidence to gather:

  • Death certificate (cause of death must be on it)
  • Veteran's military service records (DD-214)
  • Marriage certificate (if surviving spouse)
  • Birth certificates (if surviving children)
  • Medical records linking cause of death to service (nexus evidence) — especially if the cause of death is not already service-connected
  • If claiming on the 10-year 100% P&T basis: VA rating decision letter showing 100% P&T award date

If the Cause of Death Is Not Listed as Service-Connected

This is the most contested DIC scenario. You will need to establish a nexus (connection) between military service and the cause of death. Evidence that helps:

  • A physician's nexus opinion letter stating the cause of death was "at least as likely as not" caused or contributed to by military service
  • Medical literature linking service exposures (Agent Orange, burn pits, radiation) to the cause of death
  • In-service medical records documenting the condition that progressed to death

PACT Act (2022) expanded presumptive service connection for toxic exposure deaths — if the veteran served in Vietnam, Gulf War, post-9/11 combat zones, or near nuclear testing sites, many causes of death are now presumptively service-connected without requiring a nexus letter.

What DIC Does NOT Cover

  • Deaths from non-service-connected causes where the veteran was not 100% P&T
  • Survivors of veterans who were dishonorably discharged
  • Surviving spouses who remarried before age 57 (remarriage after age 57 does not disqualify)

Additional Survivor Benefits

If you qualify for DIC, also consider:

  • Survivors Pension — income-based pension for low-income surviving spouses and children of wartime veterans (separate from DIC)
  • Aid and Attendance — additional allowance if you need help with daily activities (+$385/month as of 2024)
  • CHAMPVA — VA health insurance for surviving spouses and children who don't qualify for Medicare/Medicaid
  • Fry Scholarship — education benefits for children of veterans who died on active duty or from service-connected causes
  • Dependents Educational Assistance (DEA) — similar education benefit for spouses and children
